These Terms of Purchase & Refund Policy (“Policy”) govern all purchases made from Home Care Evolution, a brand operated by Hurricane Marketing Enterprises, including purchases made:

By purchasing from us, you agree to this Policy, our Terms & Conditions, and our Privacy Policy.


1. General Terms

  • Offers and discounts may not be combined unless stated.

  • Prices are subject to change without notice.

  • We do not guarantee specific business results.

  • Testimonials do not represent typical results.

  • Entrepreneurship involves risk.


2. Home Care Evolution Alerts SMS  (A2P 10DLC Compliant)

 Home Care Evolution Alerts

The Home Care Evolution Alerts SMS  provides recurring automated SMS and MMS messages related to:

  • Purchase confirmations

  • Event reminders

  • Account notifications

  • Customer service updates

  • Promotional offers and marketing communications

Message frequency varies depending on user engagement.

Typically 1–6 messages per month. Frequency may vary.

If you enroll in the Home Care Evolution Daily Membership, you will receive one text message each business day containing business tips and educational insights related to home care marketing and growth.

Message and data rates may apply depending on your wireless carrier plan.


Opt-Out Instructions

You may opt out of the Home Care Evolution Alerts SMS Program at any time by replying:

STOP

After texting STOP, you will receive a final confirmation message and will no longer receive SMS communications from us unless you re-enroll.


Rejoining Instructions

To rejoin after opting out, you may:

  • Text START to the same number, or Re-enroll through our website registration or checkout forms.

Mobile Data Protection

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Information sharing with subcontractors who provide support services (such as customer service providers, CRM platforms, or SMS delivery vendors) is permitted solely for the purpose of operating and supporting the SMS program.

All other use case categories exclude text messaging originator opt-in data and consent information. This information will not be shared with any third parties under any circumstances.


Compliance with Industry Standards

The Home Care Evolution Alerts SMS Program complies with:

  • The Telephone Consumer Protection Act (TCPA)

  • CTIA Messaging Principles and Best Practices

  • A2P 10DLC registration requirements

  • All applicable federal and state messaging regulations


Legal Compliance Acknowledgment

By providing your mobile number, you confirm that:

  • You are the account holder or have authorization from the account holder

  • You are at least 18 years of age

  • You consent to receive recurring automated messages

  • You understand consent is not a condition of purchase


3. Physical Products

4. Digital Products

All digital product sales are final.

Upon purchase, you receive access for the duration specified in the product description.

Digital products:

  • May not be shared, reproduced, or resold

  • Are licensed to the purchaser only

  • Are non-transferable

If you experience access issues, contact Customer Support immediately.


Payment Plans

If you purchase using a payment plan:

  • You are responsible for completing all agreed payments.

  • Failure to complete payments may result in suspension or termination of access.

  • We reserve the right to pursue collection of unpaid balances as permitted by law.

  • If you believe a billing error occurred, you must contact us first to resolve the matter prior to initiating a dispute.


5. Live Event Tickets

General Policy

  • Tickets are non-refundable unless otherwise stated.

  • Store credit may be available if requested at least 15 days prior to the event.

  • Processing fees are non-refundable.

Transfers

Tickets are non-transferable without written approval.

Bundled or Promotional Tickets

Tickets included in bundles, coaching agreements, or promotional packages are non-refundable and non-transferable.

Postponement / Force Majeure

If an event is postponed due to circumstances beyond our control (Acts of God, government restrictions, etc.), tickets will be transferred to the next scheduled event date.

If not rescheduled within 180 days, store credit will be issued.


6. Ticket Holder Conduct

We reserve the right to refuse admission or remove attendees for disruptive behavior.

No refund will be issued in cases of ejection due to violation of policies.


7. Publicity Release

By attending or participating in any event hosted by Home Care Evolution, including Boot Camps, Training, or other live or virtual events, you grant Home Care Evolution and its affiliates permission to capture photographs, videos, audio recordings, and/or other media featuring your image, likeness, and voice.

You further consent to the use of such media for marketing, promotional, advertising, educational, or other business purposes, including use on our website, social media channels, email marketing, and other distribution platforms, without compensation.

You understand that attendance at an event constitutes acknowledgment and acceptance of this media release.


8. Arbitration & Governing Law

Any disputes arising from purchases shall be resolved through binding arbitration administered by the American Arbitration Association.

Jurisdiction and venue shall be Manalapan, New Jersey.


9. Affiliate & Third-Party Purchases

Purchases made through third-party affiliates are subject to that affiliate’s refund policies.

We are not responsible for refunds on products fulfilled by third parties.


10. Modifications

We reserve the right to update this Policy at any time. The updated version will reflect the revised “Last Updated” date.

Continued purchases constitute acceptance of changes.

CONSUMER OPT-IN
By opting in to receive SMS messages sent by Home Care Evolution programs, you agree to receive recurring automated marketing text messages, including purchase confirmations, event reminders, account notifications, customer service updates, promotional offers, and educational content related to home care marketing and business growth. Message and data rates may apply. You understand that you do not have to sign up for these programs in order to make any purchases of goods or services and your consent is not a condition of purchase.

You will not receive any unsolicited messages from this SMS number. The service is not intended for children under 13 and does not knowingly collect information from children under the age of 13.

Opt-Out:
You can cancel your receipt of the service by sending STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to any text message you receive or email us at info@homecareevolution.com.

CONSUMER FEES:
Our service never charges consumers to “receive” or “reply to” text messages. However, depending on your mobile service plan, message and data rates may apply.

Sprint does not support standard rate video.
Boost, VMU, and Nextel do not support MMS services.

WARRANTY:
Home Care Evolution or carriers will not be liable for any delays in the receipt of any SMS messages connected with this program. Delivery of SMS messages is subject to effective transmission from your wireless service provider network operator.
